Convicted murderer Marcus Reymond Robinson has been spared the death penalty by a North Carolina judge who says race played a factor in jury selection in his case.

A North Carolina judge ruled Friday that racial discrimination played a role in sending a black man to death row for killing a white teenager in 1991,?a groundbreaking decision rendered under the state's Racial Justice Act.

Cumberland County Superior Court Judge Greg Weeks said condemned inmate Marcus Robinson should be spared execution and instead serve a life sentence in prison without possibility of parole.


Weeks found that prosecutors deliberately excluded qualified black jurors from jury service in Robinson?s case,?and said there was evidence this was happening?in courts throughout the state.

Robinson?s case was the first to be heard under North Carolina?s Racial Justice Act, a 2009 law that allows prisoners facing execution and capital murder defendants to present evidence of racial bias, including statistics, in court.?

Weeks' ruling is expected to be the first of many involving condemned North Carolina inmates. Those who win their claims can have their sentences converted to life in prison without parole. The Racial Justice Act cannot be used to set anyone free.

"The Racial Justice Act represents a landmark reform in capital sentencing in our state," Weeks said in Fayetteville on Friday, according to The Associated Press. "There are those who disagree with this, but it is the law."

Social justice advocates have long contended that racism has put convicted killers on death row unfairly.

North Carolina has 157 death-row inmates, more than half of whom are black. All but a few have filed to challenge their sentences under the Racial Justice Act. Robinson's case?was the first?to get a hearing before a judge.

Reading a summary of his ruling from the bench, Weeks said that ?race was a materially, practically and statistically significant factor in the decision to exercise peremptory challenges during jury selection by prosecutors? at the time of Robinson?s trial. The judge added that the disparity was strong enough ?as to support an inference of intentional discrimination."

Prosecutors said Friday they planned to appeal Weeks' decision.

Robinson, now 38,?was sentenced to death for murdering 17-year-old Erik Torbblom in 1991 during a robbery. The jury that sent him to death row him had nine whites, two blacks and one American Indian.

It was later shown that prosecutors removed 50 percent of all qualified black jurors from serving on his jury, but removed only 14.8 percent of all other jurors.

In the Racial Justice Act hearing, Weeks heard testimony from experts who said race was a significant factor in jury selection in North Carolina as prosecutors decided to challenge and eliminate black jurors much more often than whites.

A Michigan State University study of jury selection practices in North Carolina capital cases between 1990 and 2010 was introduced as evidence.? The study concluded that prosecutors peremptorily struck black potential jurors at more than twice the rate they struck non-black jurors.

The Center For Death Penalty Litigation, a Durham, N.C.-based nonprofit group that helps represent defendants accused or convicted of capital crimes, praised Weeks? decision.

?This decision marks a new day for justice in North Carolina where the justice system acknowledges past discrimination and respects the rights of persons of all races to serve on juries,? the group said.

According to the center, 31 inmates on North Carolina?s death row were sentenced to death by all-white juries, and an additional 38 had juries with only one person of color.?

"North Carolina?s Racial Justice Act has proven to be a powerful tool for shedding light on discrimination in the death penalty," said Cassandra Stubbs, staff attorney for the ACLU Capital Punishment Project and part of the legal team that represented Robinson during his almost three-week-long Racial Justice Act hearing. "For over 100 years, jury selection in capital cases has been plagued by racial discrimination against qualified African-American citizens. Today?s decision offers promise that change in this area, long overdue, is finally coming.?

The only other state to pass a Racial Justice Act is Kentucky, where the law allows challenges on a pre-trial basis rather than through appeals.

North Carolina, one of 34 states that still have the death penalty, has the nation?s sixth-largest death row, according to the ACLU.

Eyes-on Brytewerks Model One high-def projector and HTPC combo

Back in January, we got our first glimpse of BryteWerks' Model One projector, albeit in render form only. Well, today at DEMO, we finally saw the thing in person and uncovered a bit more info about its innards. It still pumps out 11,000 lumens and throws images on the wall in 1920 x 1200 resolution, but it turns out to have a range of Intel silicon at its disposal: everything from a humble 1.6GHz Atom up to a 3.6GHZ Core i7. There are also multiple storage options, as the Model One comes with an Intel 320 SSD (60 or 120GB) -- where the OS resides to ensure super fast boot times -- and up to a 2TB HDD, so you have plenty of room for all your media. Speaking of the OS, it turns out the projector/HTPC has two: a customized version of XBMC and Windows 7, plus a custom GUI (currently in development) to make calibrating the projector dead simple. Because the projector's 1200-watt metal halide bulb generates so much heat, the internal chassis is built of aluminum and houses the components into four individually cooled chambers. That way, all the PC parts can stay cool on the bottom even while the projector's running full bore.

We got to see a hand-built prototype in person, and the Model One strikes an imposing, if elegant figure. It's roughly a foot and a half square cube, with a black brushed metal exterior devoid of any branding or other ornamentation, save for the silver ring around the lens. The power, HDMI, Gigabit Ethernet, USB 3.0 and four RCA connections are situated in the black plastic feet to keep cord clutter to a minimum, and the lens up front is magnetically attached to make swapping it out a simple affair. We got to speak with its creator, Justin Evans, about the genesis of the device, and he informed us that he's but a humble filmmaker who's trying to help out independent theaters, film festivals, filmmakers, and consumers. His goal was to create a projector that's both easy to use and cheap as chips (comparatively speaking) to enable film editing on the big screen and make high quality movie projection available to the masses. Given that the Model One is set to start shipping in six to eight weeks at an asking price of $2999, we'd say he's hit the mark -- assuming the image quality is as good as he says it is, and the build quality of the production model's up to snuff, of course. Here's hoping we get to see the thing in action sometime soon.

Bruce Willis Back To His Action Tricks In 'G.I. Joe: Retaliation'

But actor tells MTV News the sequel has 'action guys that can do things that I would never.'

From what we've seen thus far, "G.I. Joe: Retaliation" has a lot of things going for it. First, there's that killer trailer, and second, there's its cast of A-list action stars that include Dwayne "The Rock" Johnson and Bruce Willis.

MTV News was lucky enough to catch up with the action legend recently, and we were able to glean some insider information from Willis regarding the specifics of his character, the expectedly kick-ass General Joseph B. Colton.

"Joe Colton actually is the original G.I. Joe," Willis explained. "In the story, he started the outfit a long time ago and that outfit is all the kids that have — I mean, they are kids. Everybody is kids to [me], but we had such a great cast in this film, really funny and strong and tough guys and funny guys. Pretty girls and funny at the same time."

Willis gave a special shout-out to "Friday Night Lights" alum Adrianne Palicki (a.k.a. Lady Jaye) for being especially entertaining during filming.

"That girl cracks me up. She's so funny. She made me laugh so many times, [she's] just great," Willis said. "[We've got] action guys that can do things that I would never. I can't even call myself an action guy. This guy Byung-hun Lee [Storm Shadow] is so great. We're going to put him in another movie, he's so great, he's just awesome."

In addition to the return of Storm Shadow, the film's producer Lorenzo di Bonaventura told us that director Jon Chu has added many other elements from that aspect of the franchise. "We got red ninjas. We got Jinx. We have so much martial arts in this movie. It's really great," di Bonaventura said.

Facebook places 'Listen' button on artist pages, now takes you to your go-to streaming app instantly

If navigating away from a musician's timeline on Facebook to get a quick listen isn't your favorite activity, you're in luck. The folks in Palo Alto dropped a "Listen" button on artist pages today, giving you access to popular tracks instantly. Situated right beside the ever important "Like" button, the new feature first asks if you'd like to open your favorite music-streaming app -- either Spotify, MOG, Slacker Radio or Rdio. If you've yet to link a service to FB, it'll ask which you'd prefer to use. Once prompted in Spotify, for example, the app heads to the band's library and begins playing selections from the Top Hits category. The "Listen" button then becomes a play / pause control and clicking one on another artist's page makes the change in the app in a flash. To grab a look at the new control in action, head to your band of choice to give it a try.
