Now the setting has changed to Germany where a Dusseldorf Higher Regional Court has ruled that the Galaxy Tab 7.7 will be banned in Europe while the older brother of this gadget, the 10.1N, will be free to go. The newer 10 inch tablet was redesigned and probably steered clear of any problems on the legal side of things due to this fact. The end of this legal suit proves that a company has a relatively large reign over similar creations, or in this case things that Apple believes to be under copyright laws. They have been able to beat Samsung in this leg of the race, but as the saying goes, ?They may have won the battle, but the war is far from over.? Or something like that.
Apple even decided to go after the new 10.1N but got knocked away in February by this same Dusseldorf Regional Court where they ruled the new design was not breaking any patent or copyright laws and therefore had an original design that Apple did not come up with. It seems that technology and gadgets in general are starting to fall into the international version of the United States? larger legal system failures. In the U.S. companies are known for frivolous suits due to the availability of lawyers trying to push for outrageous claims and not to mention the amazing laws that govern patents. For this reason there are many transporting, but mainly importing, laws that hurt foreign nations that no not entirely follow U.S. laws in terms of smaller and less defended laws. It will be interesting to see if Samsung is able to keep the sale of their smaller and banned Galaxy Tab 7.7 in any European country at all because the German court was attempting to ban the sale of this gadget from the entire EU instead of just their own country due to the larger international problems that this legal battle has caused.
We have been following this legal fiasco for many months now while Apple and Samsung have moved around the globe to many different nations all fighting over the same main gadgets. In essence, Apple was one of the first companies to come up with a mass-produced mobile touch-screen device, although they seem to be the actual first to fully patent that and many operating system ideas for mobile systems. Once Apple was able to secure some trademarks on a large amount of their ideas even if they were already known by the general public and utilized freely by many, the way that trademarks and patents work is that Apple then gained a ton of freedom to legally attack other companies but mainly their harsh competitor Samsung. Time will be the only deciding factor in which company wins this battle as even after months of fighting the same battle in many different continents nothing has been set in stone for the two eager businesses.
